Land and Forestry

Fortislaw’s lawyers have extensive experience and a deep understanding of the legal and practical issues involved in land and forestry matters, particularly in the energy sector.

Our Land & Forestry team has a strong track record advising some of Indonesia’s largest onshore oil and gas and geothermal companies, particularly on projects involving large areas of land within or adjacent to forest areas. This experience gives us a practical understanding of the complex intersection between land, forestry, energy, and government regulations.

Our experience includes:

  • Land acquisition to support exploration, exploitation, and further development activities within project and work areas.
  • Resolving overlapping land and forestry areas, including issues involving project/work areas and designated forest areas.
  • Securing forestry permits and approvals from relevant government authorities, including IPPKH (now PPPKH).
  • Structuring cooperation arrangements with government agencies for activities within protected forest areas.
  • Managing land and forestry claims from individuals, communities, and NGOs, whether through negotiation and mediation or by defending claims before Indonesian courts.
  • Protecting land assets treated as state assets under Production Sharing Contracts (PSCs) and Indonesian oil and gas regulations.
  • Handover of land assets to the Government of Indonesia after Production Sharing Contract expiration.
  • Legal audit to land and forestry permits and other related documents and develop mitigation/corrective actions/improvement process when there is any deficiency.

Our approach combines legal expertise with practical experience in dealing with government authorities, communities, and other stakeholders to help clients manage land and forestry issues efficiently and protect their business interests.
